Partner Program Terms & Conditions

These Partner Program Terms & Conditions ("Terms") govern your participation in the botified Partner Program. By applying to and participating in the program, you agree to be bound by these Terms.

The botified Partner Program allows partners to earn commissions by referring qualified leads and customers to botified. The program includes:

• Qualified Lead Commission: $100 for each lead that moves to the Qualified Lead stage
• Closed Deal Commission: 15% of the total contract value for customers you refer who sign

To participate in the Partner Program, you must:

• Be at least 18 years old
• Have a legitimate business or network that aligns with botified's target market
• Comply with all applicable laws and regulations
• Have received approval from botified to participate
• Not be a current employee or contractor of botified
• Not be a competitor of botified

botified reserves the right to reject any application or terminate participation at any time.

4.1 Honest Representation

• Accurately represent botified's services and not make false or misleading claims
• Not disparage botified or its services
• Provide only truthful testimonials and case studies

4.2 Legal Compliance

• Comply with all applicable laws, including FTC guidelines on endorsements
• Disclose your affiliate relationship clearly when promoting botified
• Use only approved marketing materials provided by botified
• Not use spam, paid search ads with botified trademarks, or other deceptive practices

4.3 Quality Referrals

• Only refer leads that genuinely fit botified's ideal customer profile
• Do not submit fake, fraudulent, or low-quality leads
• Provide accurate information about your referrals

4.4 Affiliate Link Usage

• Use only your unique affiliate link to track referrals
• Not directly link to botified's payment pages or bypass the affiliate tracking system
• Not incentivize clicks on your affiliate link in ways that violate these terms

5.1 Commission Eligibility

You earn commissions only when:

• A lead comes through your unique affiliate link
• The lead is new and hasn't previously been in contact with botified
• The lead reaches the Qualified Lead stage (for the $100 commission)
• The qualified lead becomes a paying customer within 365 days of the referral (for the 15% deal commission)

5.2 No Double Commissions

You will not receive double commissions. If a lead reaches the Qualified Lead stage, you receive the $100 commission. If that same lead later closes as a customer, you receive the additional 15% deal commission. The commissions are not cumulative beyond this structure.

5.3 Commission Timing

• Qualified Lead Commission: Paid automatically when the lead reaches the Qualified Lead stage
• Deal Commission: Paid within 30 days of contract signing
• Payout Schedule: All commissions are processed monthly on the 15th

5.4 Payment Methods

Commissions are paid via:

• Bank transfer (ACH for US-based affiliates)
• PayPal or similar payment service
• Other methods as agreed upon in writing

You are responsible for providing accurate payment information. botified is not liable for payment failures due to incorrect banking details.

5.5 Minimum Payout

There is no minimum earning requirement to receive payouts. However, if your accumulated balance is less than $50, we may hold the payment until the next month to minimize transaction fees.

You agree NOT to:

• Submit fake, fraudulent, or incentivized leads
• Use paid search ads bidding on "botified" or similar branded keywords
• Spam email lists or use aggressive marketing tactics
• Misrepresent botified's services or make guarantees we don't make
• Share your affiliate link in a way that violates anti-spam regulations
• Engage in any form of fraud or deception
• Compete with botified while being an affiliate
• Directly contact botified's known customers to refer them

7.1 Termination by botified

botified may terminate your participation in the Partner Program immediately if:

• You violate these Terms
• You engage in fraudulent or deceptive practices
• You become inactive for 90+ days with no referrals
• Your referral quality is consistently poor
• We reasonably believe your participation harms botified's reputation

7.2 Termination by Affiliate

You may terminate your participation at any time by notifying us in writing. Outstanding commissions will be paid according to our normal schedule.

7.3 Effect of Termination

• Your affiliate link will no longer track new referrals
• You may not continue to promote botified
• Outstanding commissions will be paid as scheduled
• You must remove all botified promotional materials from your channels

If you believe a commission was incorrectly calculated or withheld, you must notify botified within 30 days. We will investigate and respond within 14 days. You have 60 days from notification to contest any disputed commission.

All marketing materials, logos, and content provided by botified remain botified's property. You have a limited license to use them only for the purpose of promoting botified as an affiliate. You may not modify or misuse these materials.

You agree to keep confidential any non-public information about botified shared with you as an affiliate, including earnings data, commission structures, and customer information.

11.1 Disclaimer

botified makes no guarantees about your earnings or success as an affiliate. Commission amounts are not guaranteed, and earnings depend on referral quality and customer conversion.

11.2 Indemnification

You agree to indemnify and hold harmless botified from any claims, damages, or liability arising from:

• Your violation of these Terms
• Your misrepresentation of botified's services
• Your marketing practices or promotional methods
• Any claims made by referrals you submit

You are solely responsible for:

• Reporting affiliate income to relevant tax authorities
• Paying all applicable taxes on commissions earned
• Providing tax documentation (1099 or equivalent) if required

botified will provide necessary tax documentation as required by law.

botified may modify these Terms at any time with 30 days' notice. Continued participation constitutes acceptance of modified terms. If you disagree with modifications, you may terminate your participation.

botified reserves the right to:

• Modify commission rates with 30 days' notice
• Add or remove services from the program
• Change payment methods or schedules
• Modify eligibility requirements

Commission changes do not apply retroactively to already-earned commissions.

We collect and use your personal information as described in our Privacy Policy. By participating, you consent to this data usage.

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Florida.
